GENERAL
This page is your legal agreement to the policies, terms and conditions regarding accessing, browsing, buying, etc. of Elegant Linens by Anna Rose (“ELAR”) - Online Catalog. You also agree to comply with all applicable laws and regulations, including U.S. export and re-export control regulations. If you do not agree to these terms, do not use this site. Elegant Linens by Anna Rose does not currently rent, sell or otherwise forward your name to other companies. Please see our Privacy and Security Statement for more information about your confidentiality. Comments or ideas transmitted to this site become the sole property of ELAR, and may be shared to expand or improve the functionality of the site or of our product or service offerings or for any other reason.
PRICING, SPECIFICATIONS & AVAILABILITY
Prices, specifications and availability of products are subject to change without notice. Any typographical, photographic or specification error in product, pricing or offers is subject to correction. Although Internet orders generate an automatic confirmation and response e-mail, ELAR may change its pricing, product description or specification after any order confirmation or response e-mail but prior to shipment due to errors, product discontinuation or unavailability, typographical errors, or any other reason. We will notify you of any corrections or changes and ask for your approval before we complete your order. We will not complete your order until we have your approval. Published prices do not include shipping. Items on web pages that are "cached" by our customer in their computer or in the web server of their Internet Service Provider (ISP), that have obsolete sale prices or prices that have changed will not be honored. Please refresh web pages to ensure that you have an up-to-date copy of the web page, including current pricing.
PRICE MATCH GUARANTEE
Elegant Linens by Anna Rose may not always have the lowest price, but for superior quality, our price will always be competitive. If you find a lower price anywhere else on a new, identical item, just let us know where the lower price item is. We will be happy to match the price, no questions asked!
ORDERS
After you place an order with our secure server, you will receive an automatic E-mail message confirming receipt of your order and a confirmation number for follow-up. Items that are currently in stock will be delivered to addresses in the continental USA in 2 to 7 days depending on the location. Items that are in stock by our suppliers will usually be shipped in 7-14 days. If there is extra shipping, handling or other charges for your order, we will let you know the amount when the order is confirmed. If there are taxes that apply to your order, we will also let you know the amount at that time. * If you are paying by check or money order, your order will be held for seven (7) days. If payment is not received within that time, the hold will be removed from the item(s) and your order canceled. * If payment is made by check, we will hold the item for you for an additional 10 to 15 days until our bank clears your check. Current applicable fees will be charged in cases of bounced checks.
BACK ORDERS
We specialize in the finest linens and gifts, and occasionally fine things are not available without delay. If your order, or a portion of it, is backordered, we will inform you promptly so that you may decide to hold your order until all items are available, or cancel your order. You will not be charged for any stocked items until they are shipped.
PAYMENT & SECURITY
Elegant Linens by Anna Rose only accepts credit card payments in US Dollars through VISA, MasterCard, American Express and Discover. We do not add any credit card surcharges. Please see our Privacy and Security Statement for more information about your credit card safety. All payments must be in U.S. funds. We also accept international wire transfers. We do not accept credit cards from countries other than the United States and Canada.
Like you, we are concerned about the security of online credit card transactions. You can be assured that we use an E-commerce secure server (note the lock symbol at the bottom of your browser on the Secure Shopping Basket Form page) to process your credit card and personal information. Your data is encrypted before it is sent over the Internet so that it cannot be read in transit. It is stored in a secure server. For even more security, you may place your order on-line and call in your credit card number using our toll-free telephone number. We do not sell or exchange our customer information to any other organization.
SALES TAX
Sales taxes (if any) are calculated based on the location to which the product is being shipped. Sales tax will automatically be added to your invoice if the shipping address is within Colorado. No sales tax will be charged for any other state or for Canadian customers.
SHIPPING (USA)
Our customers are very important to us, so we use UPS, whenever possible. They offer very good service and a very efficient package tracking service via the web. Due to the availability from suppliers of our fine linens, there may be a short delay before your order can be shipped. Your items usually will be shipped within 7 to 14 days of receipt of the order unless otherwise notified. Special order, backorder and personalized items will take longer. We ship to customers in the U.S. and Canada only, except by special arrangement. Federal Express shipping is available. Sorry, no COD shipments. Shipping charges on your email order confirmation may be different than the actual charges. You will be notified with any differences. INTERNATIONAL SHIPMENTS
We will gladly ship internationally, unless law restricts such shipments. We will promptly send an e-mail to you to both confirm your order and provide your shipping charges. Please remember that all customs clearing, duties and taxes are not included in the freight calculation and are the responsibility of the customer. Manufacturer's limited warranties for internationally shipped products may vary or be null and void. (NOTE: Shipments that are not retrieved from customs are not covered by our insurance.) To comply with certain vendor agreements and government regulations, ELAR reserves the right to refuse to export products from the United States at any time. If you are purchasing products for export, you are responsible for the necessary export documentation before shipment is made to a foreign country.
BACKORDERS
Unexpected circumstances may affect product availability from time to time. We apologize for any inconvenience this may cause our customers. For customers with established credit and credit card customers only, merchandise temporarily out of stock will be back ordered. Backorders longer than 7 days will be notified by email or phone. In no event shall ELAR be liable for special, incidental, consequential, punitive, indirect, or other special damages, including but not limited to loss of use or profits, however caused, whether for breach of contract, negligence, or otherwise, and whether or not ELAR has been advised of the possibility of any such damages.
RETURNS
If that rare occasion arises where you feel you must return an item, please contact us for return instructions within three (3) days (by phone or email) of receipt of your item(s). Returns Procedure - Contact our Customer Service Center at 303-437-7467 to obtain your Return Authorization Number (RAN) and details about your return process. We are unable to accept returns without a RAN number. All returns must be shipped prepaid. ELAR credits shipping charges for manufacturer defective/damaged merchandise only. Returns should be shipped to Elegant Linens by Anna Rose, P.O. Box 261096, Denver, Colorado 80226, U.S.A. The RAN number must appear on your return packing label. Please do not write on the outside of the box. To receive a refund or credit, your purchase must be returned with shipping and insurance prepaid in "as new" condition, in original box and packaging. Any variance from these conditions could result in delay or forfeiture of your refund. Shipping and insurance charges are not refunded. Refunds or credits are issued after receipt and inspection of returned goods. Refunds on purchases made with a credit card will only be made to the same card. If you have questions, comments or concerns about ELAR Return Policy, please call 303-437-7467. Returned merchandise must be received by us within seven (7) days of the date from which you contact us regarding the return.
Please note that there may be a 10% restocking charge on all returned items that are not in original condition. ELAR reserves the right to inspect and return items to you that are not acceptable for return.
Please note special orders and cut fabric are non-returnable. Special ordered items include items that we do not stock, and are indicated as such on our web site. This includes custom sizes, monogrammed items, bed skirts, and items we do not feature on our web site, but the customer requests to purchase.
Returned items must be in new and unused condition. "New and unused" means there are no marks or signs of use on the product. We cannot accept a return of any item with any indication that it has been used, or handled in such a manner that prevents us from selling it to our customers as a First Quality product. If the product is opened, it must be re-packaged as originally shipped including all tags and product inserts.
The sales receipt must accompany returned items. Please retain a copy for your records.
All items properly returned under this policy are eligible for a refund. The full purchase price less the restocking charge will be credited to the form of payment used for the original purchase.
Here is the simple process for returning an item to Elegant Linens by Anna Rose:
- Call 303-437-7467 within three (3) days of receipt to obtain a RAN. The RAN must be clearly written on the outside of the shipping container.
- Ship your return PREPAID AND INSURED for the full purchase price by a trackable carrier such as UPS or FEDEX. If you ship via United States Postal Service, we recommend that you request a receipt signature.
- We recommend that you insure the package for the full purchase price. Items lost or damaged without insurance will be the responsibility of the customer.
If you are returning a product because it is defective or we shipped you an item that you did not order, ELAR will pay the return shipping costs and there will not be a restocking charge.
DAMAGE POLICY
We take extra precautions to pack our orders to prevent damage and breakage. If, despite our efforts, your order does arrive damaged, you must work with the carrier (UPS, Postal Service, etc) to file the claim. They will normally want to see the entire order (all contents and all original packing material). They will send the claim to us for processing. Do not repack and do not return the damaged items to us unless you are instructed to do so. This will void the insurance and we will not be able to give you a refund.

The links to third party sites will let you leave ELAR's site. The linked sites are not under the control of ELAR. ELAR is not responsible for the contents of any linked site or any link contained in a linked site or any changes or updates to such sites. ELAR is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement of the site by Elegant Linens by Anna Rose.
WARRANTIES
Elegant Linens by Anna Rose does not warrant other manufacturers' products. The products are backed by the limited warranties of the original manufacturer only. The warranty period and service varies by manufacturer and product. Consult your product documentation for specific limited warranty information.
DISCLAIMER FOR WARRANTY
The title to purchased goods is retained by Elegant Linens by Anna Rose until the purchaser pays for goods. Elegant Linens by Anna Rose provides this site and its contents on an "AS IS" basis and makes no warranty or representation, either express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement. No Consequential Damages - In no event shall Elegant Linens by Anna Rose, its subsidiaries or affiliates, or their respective officers, directors, employees, representatives or agents (collectively, "Shayna Mayven, Inc.") be liable for special, incidental, consequential, punitive, indirect, or other special damages, including but not limited to loss of use or profits, however caused, whether for breach of contract, negligence, or otherwise, and whether or not Elegant Linens by Anna Rose, its parent, subsidiaries, or affiliates, or their respective officers, directors, employees, representatives, or agents has been advised of the possibility of any such damages.
TRADEMARKS AND SERVICE MARKS
Brands and trademarks are the property of their respective companies. Nothing on this site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark displayed on this site, without the written permission of the trademark owner.
LIMITATION OF LIABILITY
In no event shall Elegant Linens by Anna Rose, its parent, subsidiaries, or affiliates, or their respective officers, directors, employees, representatives, or agents be liable for direct, special, incidental, consequential, punitive, or indirect damages (including but not limited to, loss of use or profits), however caused, whether for breach of contract, negligence, or otherwise, and whether or ELAR has been advised of the possibility of any such damages. You agree that the ELAR parties’ maximum liability arising from any product sold by ELAR shall not exceed the price of such product. Some jurisdictions do not allow the limitation of exclusion of liability for certain damages so the above limitations and exclusions may not apply to you to the extent such jurisdictions law is applicable to this agreement.
PRIVACY
We appreciate you for shopping with Elegant Linens by Anna Rose. As our online customer, you can be assured that the security of the information you provide is of the utmost importance to us! We will treat your credit card number and personal data with the same high standards of confidentiality that we would expect. Our secure server ensures that the credit card and personal identification information you enter is encrypted in transmission using the latest industry-standard E-commerce technology. Nevertheless, we offer alternative ordering methods via mail, FAX or toll-free telephone. We will never sell or exchange information about our online customers to another business.
GIFT WRAPPING
We offer gift-wrapping for your fine linens or gifts. Just tell us the occasion, gift message and special instructions in the Account Notes section when you "Check Out." We can ship directly to your gift recipient if you put their address in the Ship To: section of the Secure Shopping Basket when you "Check Out." We will wrap your gifts appropriate to the occasion.
GOVERNING LAW, REVISIONS, MISCELLANEOUS
Elegant Linens by Anna Rose may revise these terms and conditions at any time by updating the ELAR web site. By using this site, you agree to be bound by these terms and by any revisions. These terms and conditions are governed and construed by the laws (but not the rules governing conflicts of law) of the state of Colorado. You agree that if any part of these terms and conditions are found to be unenforceable, the remainder of these terms and conditions will remain in full force and effect. Users of this site may use the content and software on this site as a shopping and informational resource. Any other use, including the reproduction, modification, distribution, transmission, republication, display or performance of the content on this site is strictly prohibited.
